As of midday trading on Wall Street, stocks gained on all three major U.S. indexes. The Dow Jones Industrial Average was up 6 tenths of a percent. The S&P 500 rose a half percent. And the tech-heavy Nasdaq gained 3 tenths. Comex gold futures fell $35.50 an ounce to $3,191.10. The benchmark West Texas Intermediate Crude oil futures were up 83 cents at $62.54 a barrel.
The University of Michigan’s closely-watched consumer sentiment index fell again to a near-record low. The preliminary May reading of 50.8 is down from April’s 52.2. Economists had expected it to move higher this month. But the period measured ended just as positive developments in President Trump’s trade war with China were announced on May 12. https://www.wral.com/story/americans-optimism-about-the-economy-is-at-a-near-record-low/22009569/
Cable companies, Charter and Cox have agreed to merge. Both are valued in the mid-$30b range. Charter’s Spectrum will become the consumer-facing brand for all customers of both companies. The merger follows an announcement months ago by Charter that it would acquire Liberty Broadband in an all-stock deal. Both deals are expected to close at about the same time – possibly in about a year. https://www.cnbc.com/2025/05/16/cable-rivals-charter-and-cox-to-merge.html
Dick’s Sporting Goods will pay $2.4b to acquire rival Foot Locker. Dick’s caters to a suburban, older crowd. The acquisition of Foot Locker will boost its sales internationally and with a younger, more urban clientele. To achieve that goal, Foot Locker will remain as a separate brand. The chain has 2,400 stores in 20 countries. Dick’s has yet to expand beyond the U.S. Analysts at UBS believe Nike could account for over one third of the combined companies’ total sales. In spite of the dominant position a merger would create, Dick’s CEO Lauren Hobart isn’t expecting any “regulatory concerns” from the Federal Trade Commission. www.morningbrew.com

The U.S. Supreme Court yesterday heard opening arguments in the case about whether President Trump can order an end to birthright citizenship. But there is a bigger issue at stake, which was the main focus of arguments yesterday – whether single lower-court judges can block presidential policies across the entire country. Federal District Court judges including those in Maryland, Massachusetts and Washington state have each stopped Trump’s birthright citizenship ban, effective nationwide. Over 40 nationwide injunctions by District Court judges have tried to check the President’s attempts at remaking government through executive order, which bypasses Congress, the Constitutionally-designated legislative branch of government. Observers at yesterday’s hearing say it seems like SCOTUS is uncomfortable with Trump’s executive order denying birthright citizenship, but might also move to limit lower courts’ ability to issue nationwide injunctions. There is bipartisan support for limiting lower court rulings being applied nationwide because, with more than 600 District Court judges in the U.S., a plaintiff can almost always find a sympathetic ear among at least one judge. That means almost any act by the White House could be challenged and potentially blocked in all similar situations everywhere in the country. The administration said yesterday that courts should apply injunctions only to the individual who brought the case. That has the potential to cause millions of people to have to each hire lawyers and file individual lawsuits to protect their rights – hopelessly clogging court calendars. Cases could still be appealed as high as the Supreme Court, whose decision would then apply nationwide. But you can only appeal a case that you lose. So far, all birthright citizenship cases have been won in lower courts. And the administration can choose not to appeal a case it loses to avoid setting a precedent it doesn’t like and keep the burden on individual plaintiffs. The Supreme Court is likely to rule on the birthright citizenship case in a month or two. www.NYTimes.com www.apnews.com
